Advance, deposit, rent: what the words usually mean
- Advance — money paid before you move in. In Kerala it often means a refundable sum held by the owner until you leave, but at some places it is simply the first month’s rent paid early. Ask which.
- Deposit / security deposit — a refundable amount kept against damage or unpaid dues. Some owners use “advance” and “deposit” for the same thing.
- Rent — the monthly charge. In a hostel or PG, ask whether it includes electricity, water and use of the kitchen.
- Notice period — how long before leaving you must tell the owner. If you leave without notice, part of the advance may be kept.
The single most useful question: “If I leave after three months, how much of this do I get back, and when?” Ask it before paying.

Kerala Buildings (Lease and Rent Control) Act, 1965
This is the state law that regulates the leasing of buildings, rent control and eviction in Kerala. It sets out when an owner can seek eviction and how disputes go to the Rent Control Court. Most hostel and PG arrangements are informal monthly ones, and how the Act applies to a bed in a shared room is a question for a lawyer, not a website.
The Model Tenancy Act, 2021
The Union Cabinet approved this model law in 2021. It proposes, among other things, a cap of two months’ rent as security deposit for residential premises and a written agreement for every tenancy. It is only a model: each state decides whether to adopt it. As far as we could find, Kerala has not adopted it, and the 1965 Act remains in force — check the current position if it matters to your case.
Registration and the 11-month agreement
Section 17 of the Registration Act, 1908 makes registration compulsory for leases from year to year or for more than one year, and section 18 leaves shorter leases optional. That is why many agreements in Kerala, as elsewhere in India, run for 11 months and are renewed. A shorter, unregistered agreement is still useful evidence of what you agreed; stamp duty rules under the Kerala Stamp Act still apply, so ask the owner or a document writer how it will be done.
Seven habits that save trouble
- Pay traceably. UPI or bank transfer leaves a record. If you pay cash, ask for a signed receipt with the date, amount and what it is for.
- Write down what the advance covers and when it will be returned.
- Photograph the room on day one — walls, mattress, fittings — and send the photos to the owner on WhatsApp so both sides have a dated copy.
- Agree the notice period before moving in.
- Ask about extras: electricity, water, gas, kitchen use, guests.
- Keep your ID ready for the register and police verification.
- Never pay a stranger online for a room you have not seen or confirmed with the owner by phone. Ask a friend in Kochi to check if you cannot visit.
If something goes wrong
Most disputes are about the advance at exit. Start politely, with your receipts and photos. If that fails, a word from your employer or college, or legal aid through the District Legal Services Authority, are options worth knowing about.
